Covert Surveillance – Key Terms & Conditions

By instructing Prometheus Investigations to conduct a covert surveillance operation, the client agrees to the following terms:

1. Lawful & Safe Conduct

  • All surveillance agents operate lawfully and must obey the Highway Code at all times.

  • No agent will drive, park, or manoeuvre in a manner that is unsafe, unlawful, or could draw attention to the operation.

  • Surveillance will never be conducted in a way that endangers the public, the client, the subject, or the agents.

2. Operational Limitations

  • The client acknowledges that covert surveillance does not guarantee continuous contact with a subject.

  • There is always a risk of losing a subject during a follow due to unavoidable factors, including but not limited to:

    • Minimal number of agents deployed to reduce costs

    • No GPS tracker being used

    • Limited or inaccurate intelligence regarding the subject’s movements

    • Sudden changes in direction, transport method, or environment

    • Traffic conditions, restricted access, or private property

3. Loss of Contact

  • In the event that a subject is lost, Prometheus Investigations will:

    • Take all reasonable and proportionate steps to regain contact

    • Continue intelligence-led attempts where viable

    • Keep the client updated as the situation unfolds

Loss of contact does not constitute a failure of service.

4. Client Updates

  • Throughout the operation, the client will be updated in real time via WhatsApp, where operationally safe and appropriate to do so.

  • Updates may include location changes, significant events, or loss/regain of contact.

5. Costs & Charges

  • Surveillance is charged at £45–£70 per hour, depending on factors including:

    • Location

    • Date and time (day/night, weekends, urgency)

    • Environmental conditions

    • Complexity and risk of the operation

  • Mileage is included in the hourly rate for travel up to 25 miles.

  • Travel exceeding 25 miles may be charged separately and agreed in advance.

6. Expenses

  • Additional expenses may be incurred during an operation, including but not limited to:

    • Train or bus fares

    • Parking fees

    • Other necessary travel or operational costs

  • Significant expenses will be approved by the client where possible and may be billed via a separate invoice, depending on cost.

7. Evidence & Deliverables

Upon completion of the operation, the client will receive:

  • All relevant video footage

  • A written surveillance report

At the client’s request, the following can also be provided:

  • Original memory cards

  • Agent log sheets

  • Witness statements

These materials can be exhibited in court, subject to legal relevance and admissibility.

8. Data Protection & Confidentiality

  • All agents are highly trained professionals and operate as data processors.

  • All data is handled in full compliance with UK GDPR and the Data Protection Act 2018.

  • Information gathered is processed lawfully, securely, and confidentially.

9. Acceptance

By instructing Prometheus Investigations to proceed with covert surveillance, the client confirms that they understand and accept these terms and the inherent limitations of surveillance operations.
